PGS Unfair labor Practice Hearing Decision:
On July 11, 2017 the Employee-Management Relation Board (EMRB) heard CCEA’s case filed against CCSD for making unilateral changes to the Professional Growth System and the Reference Guide and denying 128 & 225 CUs to those licensed employees who obtained credits during the 2015-16 school year that would have achieved column movement under the old salary schedule, and was told to submit transcripts pursuant to an agreement reached on April 12, 2016. After two days testimonies that included an educator, who, like so many others got his College Coursework credit values reduced to half by CCSD’s illegal act, we are thrilled that the Labor Board decided in favor of CCEA and found that the defenses raised by CCSD were without merit.
CCEA was successfully able to prove that the Reference Guide negotiated between CCEA and CCSD dated August 1, 2017 is a bargained document that cannot be unilaterally changed by CCSD without bargaining in good faith with CCEA. Similarly, CCEA was able to successfully prove that the Agreements reached around the granting 128 & 225 CUs was all bargained for and could not be unilaterally denied. In this case, it was evident to the Labor Board that CCSD’s actions were in fact a refusal to bargain and bad faith bargaining.
Most important, this decision has reinstated the integrity of this Professional Growth System that allowed Educators/Licensed Professionals to advance columns through more than simply a Masters or a Doctorate degree, but awarded CUs towards advancements for a multitude of activities that enhanced an educator’s practice and impacted student achievement and their school communities. The purpose of this monumental change to the Professional Growth System was to support educator’s growth and development to not only impact their practice, but also ensure that we can recruit and retain educators so that every student could have a quality licensed educator in their classroom.
We truly thank every CCEA member for their patience and hope this brings some peace of mind as you all get ready for the 2017-2018 school year.
Though we are waiting for a final written opinion to be issued, the EMRB has ordered CCSD to:
- Restore the PGS Guide to the Final and Approved Guide dated August 1, 2016.
- Restore and make whole to all bargaining unit employees the CUs they would have accrued under the August 1, 2017 Guide.
- Grant the 128 & 225 CUs pursuant to the Agreement reached on April 12, 2016 to all licensed employees who obtained credits during the 2015-16 school year that would have achieved column movement under the old salary schedule, and was told to submit transcripts.
- Order the parties to negotiate on any changes to the MOOCs that must be mutually agreed to by the parties.
